AIP Reached on an Extension

We write to update you on the recent meeting of your UAL IBT negotiating Committee, which took place in Cincinnati, Ohio, on February 15, 2024. During this meeting, we were able to reach an Agreement in Principle (AIP) on a new extension to our JCBA. Dear Brothers and Sisters,

We write to update you on the recent meeting of your UAL IBT negotiating Committee, which took place in Cincinnati, Ohio, on February 15, 2024. The AIP was achieved after a series of discussions and counterproposals, and it comes ten months prior to the amendable date of our current agreement.

Following this development, our legal and financial teams began immediately reviewing the AIP to finalize the terms agreed upon in this session. Once this process is complete, the committee will review the package to ensure its accuracy, at which point it will become a Tentative Agreement (TA). We will then share the details of the TA with you.

Preparations for electronic voting will also be taking place during this timeframe. Thank you for your patience and support as we work to finalize this extension.

Negotiation Update

At that meeting, the company informed us that they were interested in another extension. We told them the rank-and-file committee would evaluate any offer they might propose. We also relayed that Southwest was the industry leader for wages, and we would need to beat them in any extension offer.

December 22, 2023 - Last date to use your current United YSA debit card for purchases. After this date please securely dispose of your current United YSA debit card, as it will be deactivated.

 

December 31, 2023 - Last date to submit claims toward your 2023 balance until after the transition period.

 

January 1, 2024 - New website and Smart-Choice mobile app available. If applicable, your 2024 coverage and balances begin to become available on the new website, mobile app, and Smart-Choice debit card.

 

January 1st – January 18th - Transition period for your 2023 IBT balance. You will not have access to your 2023 balance during this time.

 

January 19, 2024 - Transition period ends. Your 2023 IBT coverage and balances are available on the new website, mobile app, and Smart-Choice debit card. Claims received after December 31, 2023, will be processed against your 2023 balance.

Your IBT Negotiating Committee met at Local 769 in Miami the week of December 4, 2023.

We started the week with your Benefits Committee to discuss Article 16 and how we can reduce benefit costs to our members across the board. As discussed at several system meetings, it is our fiduciary responsibility to determine whether TeamCare is an option that we should explore as one of the ways to reduce overall benefits costs to all members.

With that in mind, TeamCare gave us a presentation as to what they can offer our members in reducing the costs of our benefits while improving the overall maintenance of benefits. They gave us a comparison of benefits and costs to give us a preliminary idea of whether they could provide the membership with the cost savings we were looking for. When they finished with their presentation, the benefit and negotiating committees discussed what was presented and then the negotiating committee voted to task the benefit committee with continuing discussions with TeamCare as an option, and to bring back a proposal to the negotiation committee. Reducing Benefits costs was one of the top issues that the members brought up in the survey that needed to be addressed in negotiations.

The afternoon of December 5, your negotiating committee discussed Article 17 “Overtime”. We discussed “will work letters” (a method to auto accept overtime) and job continuation. We also talked about overtime bypasses being an issue and solutions to keep bypasses low and to make sure the system is more constant in application with local issues being addressed by utilizing paragraph J with “Overtime” guidelines.”

Wednesday, December 6, we started with our attorneys, Josh McInnerney and Emily Pantoja, to go over Article 19, “Grievance and Disciplinary Procedures,” and Article 20, “Arbitration.”

We went line by line to change what is broken or not working the way we believe it should work to better protect our members. We went over several solutions to improve the grievance process so our member’s issues are resolved per the agreement. Our attorneys will firm up the changes and return the articles to us and add them to other articles that will be part of our full pass to the company.

We finished the week with a Zoom call with our IBT Economist Kyle Schoembs to go over our wage components and where we are now as compared with other carriers and where we all be through 2026.

Finally, the section 6 notification has been filed and acknowledged by the company. The union is looking for dates in January to meet with the company.

Some members had difficulty in signing up for the app. There was an anomaly in the list of members birthdates. For these members when a two-digit year was in the block, the program automatically formatted it to add 20 in the front.

For instance, if your birth year was 1963, but the data showed 63, the newly formatted data became 2063. That is now fixed, and those members should have no trouble signing up now.

During these two-day meetings, several crucial discussions took place regarding potential changes and enhancements to Article 16. The committee worked diligently to ensure that any proposed changes align with the best interests of our members.

The outcomes of these discussions will now be categorized and relayed to the negotiating committee. These proposals will play a pivotal role in future negotiations with the company. When negotiations begin, the committee will reconvene as necessary to assist the negotiating committee with any benefit-related questions or concerns.

The week began with an in-depth review of the survey results that you, our members, participated in. We want to express our gratitude for your valuable input. Although there was substantial information to sift through, we were pleased to discover that the committee's priorities align with your concerns. Your feedback has been instrumental in guiding our efforts.

In addition to reviewing the survey results, we have diligently checked the survey proposals you submitted. Each proposal is crucial in shaping our negotiating stance and ensuring your voices are heard. 

During the meeting, we successfully concluded discussions on Article 6, which pertains to Reduction in Force, and Article 18, which addresses Union Representation. These articles were voted on and added to our comprehensive package to be presented to the Company during our face-to-face negotiations. Your committee believes these additions will strengthen our position and benefit our members.

To wrap up the week, we discussed potential improvements to Article 8 Holidays and Article 9 Vacation. The committee thoroughly reviewed and voted on these articles, marking another step towards enhancing the benefits and working conditions for our members.

I've received several questions about the rank and file committee. This committee is comprised of members that work under the terms of the contract. In bargaining, by majority vote, they determine what is agreed upon. At the end of bargaining they determine whether the terms are acceptable to bring to a membership vote. This vote is commonly referred to as converting the package to a TA or Tentative Agreement. You will hear more from the rank and file committee as bargaining progresses.  

Per the committee's request, the survey will be open for 30 days. It should take around five minutes to complete.

 Grievance Committee Election Guidelines 2023 

  • The positions that are open for nominations are as follows: Coordinator, Grievance Secretary, Jet Shop Chief Steward, Line Chief Steward, Back Shops Chief Steward, and Facilities Chief Steward.

  • Term shall be for three years.

  • All nominations must be submitted between May 30 through June 1, 2023, at the SFO Base IBT office between the hours of 0400 and 1600. Local 856 Business Agent Javier Lectora and/or Local 986 Business Agent Mark DesAngles will be present to verify receipt of all nomination forms.

  • A written Nomination/Acceptance form will be provided and may be submitted on behalf of any nominee not present to accept the nomination in person. Forms will be available upon request at the SFO Base IBT Office.

  • Nominees must be a member in good standing and be current on dues payments at the time of nomination. Once elected, you will be required occasionally to cover all 3 shifts. Most importantly, enforce the CBA and NOT bring disparage/reproach upon the Locals and/or the IBT.

  • The election process will begin within 15 working days of the completion of nominations

  • Only members in good standing will be eligible to vote. The member’s address on file at the Local Unions will be utilized to mail voting instructions. Members are encouraged to contact their respective Local to ensure their mailing address is current. (Members with the last name A-LED, should call Local 856 at 650 635 0111 and members with the last name LEE-Z, should call 626 350 9860.)

  • The vote will be administered by BallotPoint. Members will receive voting instructions in the mail and will be able to cast their ballots online or via telephone.

  • Duplicate ballot request procedures will be communicated prior to the commencement of the voting period.

  • Upon conclusion of the ballot count, newly elected committee members will be contacted in writing by Local 856 Business Agent Javier Lectora and/or Local 986 Business Agent Mark DesAngles.

  • Newly elected positions will take effect in September 2023.

  • At any time during the 3-year term, the membership may petition the local union to remove a committee person. A minimum of 25% of the members in the eligible voting group must sign the petition for it be considered by the Local Union. Upon receipt of a valid petition for removal, a committee made up of local union Business Agents shall conduct an investigation to evaluate the merits of the request. At the conclusion of the investigation, the local union will announce its finding and will determine if the removal of the committee person prior to the conclusion of their elected term is warranted.

The IBT Rank and File Negotiating Committee convened in Boston, Massachusetts at Local 25, the week of July 10, 2023.

The Committee started the week discussing the need for another survey to ensure the committee is still on the same page as the membership’s priorities. In the end, it was agreed that a survey was necessary due to the time since the last survey has been over a year and the memberships dynamics have changed (due to new members being hired since the last survey). The Committee formulated a survey, agreed upon its contents, and it will be electronically sent out to membership.

Additionally, we continued reviewing and finalizing more of the non-economic articles in the agreement. The following articles were finalized and voted on by the Committee and are ready to present to the Company when negotiations reconvene this coming December 2023: Articles 10-Leaves of Absence, 11-Sick Leave, 12-Field Trips, 14-Safety and Health, 5-Vaccancies, 21-General and Misc.

The Team finished the week beginning a review of the LOA’s, going through them to see where improvements can be made or if it is more advantageous to incorporate a particular LOA into areas of the agreement. The remaining Articles require the guidance of our legal team to help make sure we incorporate the best language possible to protect our members.

The Committee is slated to meet on the west coast in the near future to continue the review of the non-economic Articles and LOAs.

We are reaching out to provide you with an update on the recent Principal Officer Meeting, which took place Monday at the International Brotherhood of Teamsters (IBT) headquarters in Washington, D.C. The meeting was centered around the upcoming bargaining process as well as a review of the number of grievances at system board and arbitration.

Here are the key points discussed during the meeting:

1. Preparations for Bargaining:

The leadership acknowledges the significance of thorough preparation for the upcoming negotiations with management. To ensure effective representation, a dedicated Bargaining Committee comprising experienced individuals from our hub cities has been formed. Most of the previous members will return for this round of bargaining. The commitment from the Principal Officers is to assertively advocate for our best interests during the bargaining process.

2. Reviewing Grievances:

The meeting involved an overview of the grievances filed, and an update on their current status in the docket. We recognize the importance of ensuring your grievances are heard in a timely manner, and efforts are underway to address the current backlog. Initiatives to expedite the process were shared, including the exploration of increased arbitrator availability through collaboration with the company and the National Mediation Board (NMB). Expanding the pool of arbitrators will be critical as the current panel ages, and delaying action will further diminish the available resources.

3. Transparent Communication:

Emphasizing the importance of transparency, we discussed the necessity of keeping all members well-informed and engaged throughout the bargaining process. To achieve this, regular updates will be provided through various channels such as emails, the new app, and our union website. We also explored options for facilitating member inquiries and feedback, recognizing the value of your input in shaping our priorities and strategies. 

4. Learning and Training:

In our commitment to supporting our members, we have planned a range of educational initiatives. These include training videos and other means of disseminating informative materials to foster an informed membership. Equipping our members with knowledge and resources will strengthen our negotiating committee's capabilities and advance our collective objectives.

Given that there are several new members who may not be familiar with these provisions, it is prudent to provide a concise explanation.

Dear Brothers and Sisters,

We have recently received inquiries from two Chief Stewards in San Francisco regarding the applicability of force majeure provisions outlined in our Collective Bargaining Agreement. Given that there are several new members who may not be familiar with these provisions, it is prudent to provide a concise explanation.

Force majeure is a legal term that refers to unforeseen and unavoidable events or circumstances that are beyond the control of the parties involved in a contract. It is commonly included as a clause in contracts to allocate risks and liabilities in the event of such occurrences.

Force majeure events typically include natural disasters (such as earthquakes, hurricanes, or floods), acts of war, terrorism, government actions (such as expropriation or changes in laws), labor strikes, epidemics, or any other event that is considered unforeseeable, unavoidable, and beyond the control of the parties.

When a force majeure event occurs, it may excuse or suspend the affected party's performance of their contractual obligations. In other words, it relieves the parties from fulfilling their contractual duties temporarily or entirely, depending on the specific terms outlined in the contract.

The specific language and requirements for invoking force majeure will vary depending on the jurisdiction and the terms of the contract. It is important for the parties to carefully review the force majeure clause in their contract to understand the circumstances under which it can be invoked and the procedures to follow in such situations.

It is worth noting that force majeure is a legal concept, and its application depends on the specific circumstances and the interpretation of the contract by the parties involved or a court of law, if necessary.

Currently, there are four provisions within our Agreement that encompass a force majeure modifier or definition. The initial provision can be found in Article 1.B.10,b Scope, which permits furlough from SFO or IAH in the presence of specific conditions. This also applies to LOA 18, which safeguards against system-wide furlough. Another instance of a modifier to the standard language exists in Article 17.H.6,d, which addresses forced overtime and allows the company, under certain conditions, to mandate overtime work. This provision in Article 17 is connected to the definition of an emergency outlined in Article 2 M.

Now that we have established what force majeure entails and which provisions it modifies, we must address the question of whether these modifiers continue to apply. To clarify, the national travel emergency concluded over a year ago, and the company's ability to utilize these modifiers ceased at that time. Moreover, even if our interpretation is incorrect, it is undeniable that the national emergency ended on May 11th, when President Biden signed the bipartisan congressional resolution. As far as I am aware, the company has not attempted to assert their right to invoke these provisions since the furloughs of 2020. Consequently, they no longer possess, and have not possessed for a significant period, the capacity to utilize these modifiers beyond the limited and prescribed terms for the application of force majeure. In simple terms, the modifiers are no longer applicable.

The meeting started on May 23 with a review of the previous ratification process. We talked about what went well and what didn't during that time. We had a good discussion where everyone shared their thoughts and ideas. Here are a few of the important things we talked about:

Day 1: Looking Back at What Worked and What Needed Improvement and Review of Article 13

The meeting started on May 23 with a review of the previous ratification process. We talked about what went well and what didn't during that time. We had a good discussion where everyone shared their thoughts and ideas. Here are a few of the important things we talked about:

  1. 1. Things that went well:

    • The ratification process itself went well with few issues reported.

    •  Sharing information with the membership went well after the initial flurry of misinformation was released.

  2. Challenges we faced:

    • Accurate information took longer to share than it should have because of the steps we had to follow. We talked about finding ways to make the process faster and smoother next time. This is especially important as there was a massive disinformation campaign.

    • Communication avenues we used in the past were insufficient and we talked about if they still make sense for the future. Some platforms are still useful, but we need to expand the ways we communicate and consider the diverse way the entire group receives information.

There was a vigorous discussion as to whether another membership survey is needed. As a committee, we decided it was important to conduct another survey, but with questions designed by the rank-and-file members to better reflect your interests. It was determined that questions asked will include listing your top priorities for the next agreement approximating what was fielded in 2013. Look for the survey to launch sometime after the Principal Officers meeting at the end of June.

Before lunch we discussed the need for a system-wide membership education campaign around your right to a steward any time you are to be questioned in an investigation that may lead to discharge or discipline. This is particularly true when being questioned by corporate security. The company appears to have violated Article 18.O several times when corporate security conducts investigations. We will keep you posted as more information becomes available on this very important protection in the future.

After lunch we reviewed Article 13 Training. After an intensive review, we recognized that most of the issues we identified in the Article last year remain relevant and will need to be addressed in bargaining. This Article took us the remainder of the afternoon to discuss.

 

Day 2 Reviewing the New Airline Division App as well as Articles 3 and 7

On May 24th, we gathered to review the new Airline Division app that is in development. The purpose of the review was to assess its functionality, usability, and relevance to our needs. Here are the key points discussed during the session:

  1. 1Functionality:

    • We examined the app's features and assessed whether they aligned with the requirements outlined during the development phase.

    • The committee explored different functionalities such as updates, targeted notifications, and other relevant industry information.

    • We identified any potential issues or glitches that need to be addressed to ensure smooth operation.

  2. Usability:

    • Participants tested the app's user interface and evaluated its ease of use.

    • We considered factors such as intuitive navigation, clear instructions, and efficient information retrieval.

    • Feedback was provided on areas where improvements or simplifications could enhance the overall user experience.

  3. Relevance:

    • We compared the app's capabilities to the specific needs and goals of the Airline Division membership.

    • The committee analyzed whether the app adequately addressed the challenges faced by Division members and supported our needs.

    • Suggestions were made to align any necessary adjustments or enhancements with our membership’s objectives.

Overall, the meeting allowed for a comprehensive review of the new Airline Division app. Feedback and suggestions were shared to ensure that the app meets our needs effectively. The next steps involve addressing any identified issues, refining the app's functionality and usability, and aligning it closely with our requirements prior to launching it system wide. Given the nature and size of the group, the app will initially focus on the United membership before deploying to the whole Division.

We finished the day discussing Article 3 Covered Crafts Classifications and Bid Areas, as well as Article 7 Hours of Service. All three Articles discussed over the course of the two-day meeting are now ready to pass to the company when we reengage. The committee is determined to deliver you an industry leading agreement that you can truly be proud of. We are unwavering in that commitment to you because your skill and talent deserves nothing less.

Just prior to the conclusion of the meeting we discussed possible locations for the next meeting and discussed that the next meeting will occur after the Principal Officers meet in Washington D.C. on the 26th of June.

March 2023 CARP Announcement

The new interest rates for the Continental Retirement Plan (CARP) are now available on Your Benefits Resources (YBR). Anyone who runs an estimate with a benefit commencement date of 7/1/2023 - 12/1/2023 will have the new rates applied. 

The interest rates for lump sums payable from 7/1/2023 to 12/31/2023 are 4.99%, 5.12% and 4.96%. These are based on the IRS published three “segmented” interest rates each month. United is using the February rates published in mid-March 2023.

As a result, lump sums paid in the second half of 2023 will be lower than the lump sums paid in the first half of 2023. The following are estimated impacts:

A lump sum of $100,000 based on the rates and mortality table for the first half of 2023 would be equal to the following amounts using the rates and mortality table for the second half of 2023: 

Age 50 retiree = $93,000 (7.0% lower) 

Age 55 retiree = $93,000 (7.0% lower) 

Age 60 retiree = $95,000 (5.0% lower) 

Age 65 retiree = $96,000 (4.0% lower) 

These new rates are posted on United’s Flying Together website under the Your Benefits Resource (YBR) tab as of March 31st. You will be able to run estimates after that date. 

If you have any questions concerning the impact of projecting your retirement with a benefit commencement date of January 1, 2024 or later, please note that the interest rates that are used to project in the future will use the higher of an average of the segmented rates during the 24-month period from March 2021 through February 2023 or the most recent rates published by the Plan (February, 2023 rates, published in mid-March, 2023), which may or may not be reflective of current segmented rates. Since the actual interest rates for these projections are currently unknown, the system will also show estimated lump sum amounts using three segment rates that are each 0.5% or 1.0% higher or lower than the 24-month average rates.  The actual interest rates that will be used to calculate your lump sum when you retire will be based on the interest rates in effect at that time.
